General Terms and Conditions

1. Scope

The following General Terms and Conditions apply to all orders placed through our website. The offering on this website is intended exclusively for consumers residing in Switzerland or Liechtenstein (hereinafter the "customer").

A consumer is a natural person whose business relationship with Anykey Solutions GmbH is unrelated to their trade or self-employed professional activity. Orders for quantities exceeding normal household requirements may be rejected without giving reasons.

Anykey Solutions GmbH reserves the right to amend these Terms and Conditions at any time. The version in force at the time of the order applies and cannot be changed unilaterally for that order. Customer terms that conflict with or deviate from these Terms and Conditions will not be recognised.

2. Information on this website

This website contains information about products and services. Prices, the product range and technical specifications are subject to change. All information on this website (product descriptions, images, illustrations, videos, dimensions, weights, technical specifications, accessory compatibility and other details) is for illustrative purposes, is to be understood as approximate and is non-binding. In particular, it does not constitute any assurance of characteristics or guarantee unless expressly stated otherwise. Anykey Solutions GmbH endeavours to present all details and information on this website correctly, completely, clearly and up to date, but cannot provide any express or implied warranty in this respect.

3. Prices and delivery costs

The selling prices shown on this website are final prices and, unless otherwise stated, include statutory value added tax and any other statutory charges, such as advance recycling fees or copyright levies on electronic equipment. Prices are quoted net in Swiss francs (CHF).

Delivery costs are included in the stated selling prices. No additional shipping costs apply.

Technical changes, errors and printing mistakes are reserved. In particular, Anykey Solutions GmbH may change prices at any time without prior notice. Selling prices do not include advisory or support services.

4. Formation of the contract

The products and prices on this website constitute non-binding offers.

By placing an order through this website and accepting these Terms and Conditions, the customer submits a legally binding offer to enter into a contract. Anykey Solutions GmbH then sends an automatic order acknowledgement by email confirming receipt of the customer’s offer. Orders placed are binding on the customer. Unless otherwise stated, there is no right of return or withdrawal.

The contract is formed once Anykey Solutions GmbH sends an acceptance by email confirming dispatch of the products or services ordered.

Orders are dispatched only after full payment has been received (except for delivery against invoice) and provided that the goods are available. If the ordered goods cannot be supplied, or can only be supplied in part, Anykey Solutions GmbH may decline to accept or fulfil the order, or accept or fulfil it only in part. In such cases, Anykey Solutions GmbH will notify the customer by email. If the customer’s payment has already been received, it will be refunded. If no payment has yet been made, the customer is released from the obligation to pay.

5. Payment and retention of title

The customer may use the payment methods indicated during checkout.

Anykey Solutions GmbH reserves the right to exclude customers from individual payment methods without giving reasons or to insist on payment in advance.

If the customer is in default of payment, Anykey Solutions GmbH may charge default interest of 5% per year and a reminder fee of up to CHF 20 per reminder.

Products delivered to the customer remain the property of Anykey Solutions GmbH until paid for in full.

6. Delivery and inspection

Deliveries are sent by post or courier to the address provided by the customer in the order.

Anykey Solutions GmbH endeavours to keep delivery times as short as possible. Any delivery times stated in the order confirmation are, however, non-binding. Anykey Solutions GmbH is entitled to make partial deliveries.

If a delivery cannot be made or the customer refuses to accept it, Anykey Solutions GmbH may terminate the contract after notifying the customer by email and allowing a reasonable additional period, and may charge for the expenses incurred.

The customer must inspect the goods immediately upon receipt and report any defects covered by Anykey Solutions GmbH’s warranty without delay, in writing by letter or email to the address in the legal notice.

7. Right of withdrawal

There is no right of withdrawal.

8. Warranty

Anykey Solutions GmbH endeavours to supply goods of faultless quality. For defects reported in good time, Anykey Solutions GmbH warrants that the item purchased by the customer is free from defects and functions properly during the statutory warranty period, generally two years from the delivery date. Anykey Solutions GmbH may, at its discretion, fulfil the warranty by providing a free repair, an equivalent replacement or a refund of the purchase price. Any further warranty rights are excluded.

The warranty does not cover normal wear and tear, the consequences of improper handling or damage caused by the customer or third parties, or defects attributable to external circumstances. Warranty coverage is also excluded for consumables and wear parts (e.g. batteries, rechargeable batteries, etc.).

9. Liability

Anykey Solutions GmbH cannot provide assurances or guarantees concerning the currency, completeness and accuracy of data or the permanent or uninterrupted availability of the website, its functionality, integrated hyperlinks and other content. In particular, no assurance or guarantee is given that use of the website will not infringe rights belonging to third parties rather than Anykey Solutions GmbH.

Anykey Solutions GmbH excludes all liability, regardless of its legal basis, as well as claims for damages against Anykey Solutions GmbH and any assistants or agents involved in performance. In particular, Anykey Solutions GmbH is not liable for indirect losses, consequential losses arising from defects, lost profits or any other personal injury, property damage or purely financial loss suffered by the customer. Any more extensive liability imposed by mandatory law remains reserved, for example in cases of gross negligence or unlawful intent.

This website uses hyperlinks solely to make it easier for the customer to access other online offerings. Anykey Solutions GmbH cannot know the detailed content of those offerings or accept liability or any other responsibility for the content of those websites.

10. Data protection

Anykey Solutions GmbH may process and use the data collected when the contract is concluded to fulfil its obligations under the purchase contract and for marketing purposes. Data required to provide the services may also be disclosed to commissioned service partners (logistics partners) or other third parties.

11. Other provisions

If any provision of these Terms and Conditions is or becomes invalid or unenforceable, the validity of the remaining provisions is unaffected.

Anykey Solutions GmbH expressly reserves the right to amend these Terms and Conditions at any time and bring them into effect without notice.

In the event of a dispute, substantive Swiss law applies exclusively, to the exclusion of conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods (CISG, Vienna Convention) is expressly excluded.

The place of jurisdiction is 8910 Affoltern am Albis ZH or the consumer’s place of residence.
